Terms & Conditions

1. Introduction Welcome to Facet, a product and service operated by Hopific, a company registered in the Netherlands. By accessing or using our website and downloading our Grasshopper scripts (“Products”), you agree to be bound by these Terms & Conditions. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Merchant of Record & Consumer Rights Our order process is conducted by our online reseller, Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Your legal contract of sale is with Lemon Squeezy, who processes your payment, handles taxes, and issues your receipt/invoice.

  • Waiver of Right of Withdrawal (EU Consumers): Because our Products are digital files that are available for immediate download, you expressly consent to the immediate delivery of the content. By doing so, you acknowledge and agree that you lose your 14-day right of withdrawal and that all sales are final. We do not offer refunds.

3. Intellectual Property & Acceptable Use All scripts, algorithms, and digital files provided by Facet remain the exclusive intellectual property of Hopific. Upon purchasing a subscription, Hopific grants you a limited, non-exclusive, non-transferable license to use the downloaded scripts.

  • Permitted Use: You may use the scripts commercially in your architectural and design projects. No attribution is required.

  • Prohibited Use: You are strictly prohibited from reselling, sublicensing, distributing, sharing, or giving away the raw scripts or files to any third parties. You may not reverse-engineer the files to create competing products, nor may you use our scripts to train machine learning or artificial intelligence models.

4. Subscription Plans & Access We offer different subscription tiers:

  • Individual Plan: This plan is strictly for a single individual user. The files provided under this plan contain a script-based file-lock. Once your subscription expires or is canceled, the files will lock and can no longer be used. Attempting to hack, bypass, or reverse-engineer this file-lock is a material breach of this contract, resulting in immediate account termination and potential legal action.

  • Studio Plan (and above): This plan covers multiple users within the same corporate entity. Scripts downloaded under this plan do not contain a file-lock and remain perpetually editable by your company even if the subscription ends.

  • Account Misuse: Logins are monitored. Sharing login credentials with unauthorized individuals or external firms is prohibited. Hopific reserves the right to suspend or terminate accounts without refund if misuse is detected.

5. Feedback If you provide us with any ideas, feature requests, or suggestions (“Feedback”), you grant Hopific a perpetual, irrevocable, royalty-free license to use and incorporate that Feedback into our Products without any obligation or compensation to you.

6. Disclaimer of Warranties (“As Is”) The scripts and services are provided strictly on an “AS IS” and “AS AVAILABLE” basis. Hopific makes no warranties, express or implied, regarding the scripts. We do not guarantee that the scripts will be error-free, bug-free, or meet your specific project requirements. Hopific is not responsible for any software crashes, project delays, or missed deadlines resulting from the use of our scripts.

7. Limitation of Liability & Indemnification To the maximum extent permitted by applicable Dutch law, Hopific shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Products. In no event shall Hopific’s total liability exceed the amount you paid for the subscription in the twelve (12) months preceding the claim. You agree to indemnify and hold Hopific harmless from any claims, damages, liabilities, or legal fees arising from your unauthorized use of the Products, your violation of these Terms, or any structural/design defects in physical projects resulting from the use of our scripts.

8. Export Controls You agree to comply with all applicable export and re-export control laws and regulations. You represent that you are not located in a country that is subject to a governmental embargo or designated as a “terrorist supporting” country.

9. Modifications Hopific reserves the right to modify these Terms at any time. We will notify users of significant changes via email or a prominent notice on our website. Continued use of the service after changes constitutes acceptance of the new Terms.

10. Governing Law These Terms shall be governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
